Latitude Escapes Website Terms and Conditions

These Terms and Conditions govern your use of the Latitude Escapes website and any direct reservation request or booking made through it. They explain when a reservation becomes binding, how payments and cancellations are handled, and the basic rules that protect guests, the property, and the host. Please read them before using the website or submitting a booking.

A confirmed stay is also governed by the reservation details, the signed Vacation Rental Agreement, applicable property rules, and any separate waiver required for recreational equipment. If those documents conflict with these website terms, the signed Vacation Rental Agreement and the reservation-specific details control for that stay.


1 Acceptance of These Terms

By accessing this website, submitting an inquiry, requesting or completing a reservation, making a payment, or electronically accepting a document, you agree to these Terms and Conditions. If you do not agree, do not use the website or complete a direct booking.

You must be at least 25 years old and legally able to enter into a binding agreement to make a reservation, unless the host approves a different minimum age in writing. The person who books the property is the Primary Guest and is responsible for the reservation, all payments, and the conduct of every member of the party and every visitor.


2 Website Purpose and Availability

This website provides information about Latitude Escapes and its vacation rental property, including photographs, amenities, availability, rates, and options to inquire or book directly. Website content is provided for general information and may be updated without notice.

We work to keep the website accurate and available, but we do not guarantee that every description, rate, calendar entry, image, or feature will be complete, current, or error-free at all times. A displayed rate or available date does not by itself create a reservation. We may correct an obvious pricing, calendar, or content error before accepting a booking and will notify you if a material correction affects your request.


3 Reservation Confirmation

A direct reservation is confirmed only after all required steps are completed:

• the reservation request has been accepted by Latitude Escapes;

• the Primary Guest has completed and signed the Vacation Rental Agreement;

• the required initial payment has been received and cleared; and

• Latitude Escapes has issued written confirmation of the reservation.

Until confirmation is issued, dates may remain available to other guests. We may decline a reservation request when information is incomplete, payment cannot be processed, the requested use is inconsistent with property rules, or the reservation cannot lawfully or safely be accommodated.


4 Rates Taxes Fees and Payments

The checkout page or written quote will identify the nightly rate, taxes, cleaning fee, pet fee if applicable, and any other disclosed charge. Taxes and fees may change when required by law or when a reservation is modified.

The initial payment is due when the reservation is made. The remaining balance is due on the date shown in the reservation details or Vacation Rental Agreement. Failure to pay an amount when due may be treated as a guest cancellation and may result in release of the reserved dates, subject to the cancellation terms below.

Payments may be processed by Hostaway, Stripe, or another third-party payment provider. Your use of a payment provider may also be subject to that provider's terms and privacy practices. You authorize the disclosed charges and represent that you are authorized to use the payment method submitted.


5 Cancellation and Refund Policy

Unless a different written policy is expressly included in the confirmed reservation, the following policy applies to direct bookings:

How to cancel. Send a written cancellation request to Hello@latitudeescapes.com. The cancellation is effective when Latitude Escapes receives it. Refunds are returned to the original payment method when reasonably possible, except where applicable law requires another method.

If cancelled dates are later rebooked, Latitude Escapes may choose to provide an additional refund based on the replacement revenue received, after reasonable costs. Any additional refund is discretionary and is not guaranteed. No refund is due for late arrival, early departure, weather conditions, red tide, travel delays, personal circumstances, dissatisfaction with conditions outside the property, or interruption of nonessential services, except as required by law or expressly agreed in writing.

If Latitude Escapes must cancel a confirmed reservation and cannot provide a reasonably comparable alternative accepted by the guest, the guest will receive a refund of amounts paid to Latitude Escapes for the cancelled stay. This is the guest's exclusive contractual remedy for a host cancellation, except where applicable law provides otherwise.


6 Changes to a Reservation

Any request to change dates, guests, pets, or other material reservation details is subject to availability and written approval. A change may affect rates, taxes, fees, minimum-stay requirements, or cancellation treatment. A date-change request is not effective until confirmed in writing. A change made to avoid a cancellation deadline may be treated under the policy that applied to the original reservation.


7 Occupancy Guests and Permitted Use

The maximum overnight occupancy is six guests unless Latitude Escapes approves otherwise in writing. Only registered guests and approved visitors may enter or use the property. The property may be used only as a private vacation residence. Parties, events, receptions, commercial activity, photo or video productions, and other gatherings are prohibited unless approved in writing before arrival.

The Primary Guest must remain at the property for the reservation and may not transfer, assign, resell, or sublet the reservation. False information, unauthorized occupancy, or an unauthorized event may result in immediate termination of the stay without refund, to the extent permitted by law.


8 House Rules and Property Care

Guests must follow the Vacation Rental Agreement, posted instructions, safety notices, and reasonable directions from the host or property manager. Key rules include:

• no smoking or vaping inside the home;

• quiet hours beginning at 10:00 p.m.;

• no parties, disruptive conduct, unlawful activity, or commercial use;

• no thermostat setting below 73 degrees Fahrenheit;

• pets only with prior approval and payment of any applicable pet fee; and

• reasonable care of the home, furnishings, dock, pool, spa, outdoor areas, and equipment.

The Primary Guest is responsible for damage, loss, excessive cleaning, unauthorized use, fines, and other costs caused by the guest party or visitors, beyond ordinary wear and tear. Guests must promptly report damage, hazards, maintenance problems, or unsafe conditions.


9 Amenities Water Access and Recreational Equipment

The property may include a pool, spa, dock, waterfront access, kayaks, paddleboards, life jackets, grills, cooking equipment, a boat lift, and other amenities. Availability may be affected by maintenance, weather, water conditions, government action, or safety concerns. No particular amenity is guaranteed to be continuously available unless the reservation expressly states otherwise.

Water activities and recreational equipment involve inherent risks. Guests use the pool, spa, dock, shoreline, kayaks, paddleboards, grills, boat-related facilities, and other equipment at their own risk and must follow all instructions, capacity limits, laws, and safety requirements. A separate waiver may be required before certain equipment may be used. Children and persons who cannot safely use an amenity must be actively supervised by a responsible adult.


10 Access Maintenance and Emergencies

Latitude Escapes and its authorized representatives may enter the property at reasonable times and, when practical, after notice, to perform maintenance, address a reported issue, inspect suspected damage or rule violations, protect persons or property, comply with legal requirements, or respond to an emergency. In an emergency, advance notice may not be possible.

Guests must promptly report urgent conditions. If a problem can be reasonably corrected during the stay, the guest must allow a reasonable opportunity for correction before requesting a remedy.


11 Security Cameras and Privacy at the Property

Exterior security cameras may monitor outdoor areas for safety, security, occupancy verification, and protection of the property. There are no interior surveillance cameras in private living areas. Guests may not cover, disable, move, or interfere with security or safety devices. Additional details may appear in the listing or Vacation Rental Agreement.


12 Weather Travel and Service Interruptions

Florida travel and waterfront stays can be affected by hurricanes, tropical weather, flooding, red tide, insects, wildlife, air or water conditions, road closures, utility outages, internet or cable interruptions, and government orders. These circumstances may arise without warning and may be outside the control of Latitude Escapes.

Guests are responsible for monitoring travel conditions and obtaining travel insurance that fits their needs. Unless required by law or expressly stated in the confirmed reservation, events outside the control of Latitude Escapes do not change the cancellation policy. If a mandatory evacuation order or other legal restriction makes occupancy unlawful, Latitude Escapes will apply the remedy required by law and any applicable written policy.


13 Third Party Services and Links

The website may use or link to services operated by other companies, including booking, payment, mapping, review, communication, and social media services. Latitude Escapes does not control those services and is not responsible for their content, availability, security, or privacy practices. A link does not imply endorsement. Use of a third-party service is subject to that provider's terms.


14 Intellectual Property

The website design, text, photographs, graphics, logos, and other original content owned by Latitude Escapes are protected by applicable intellectual property laws. You may view and print website content for personal, noncommercial use related to evaluating or managing a stay. You may not reproduce, sell, publish, distribute, modify, scrape, or commercially exploit website content without prior written permission, except as allowed by law.


15 Disclaimer and Limitation of Liability

To the fullest extent permitted by law, the website is provided on an as-is and as-available basis. Latitude Escapes disclaims implied warranties relating solely to website operation, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement, except to the extent a warranty cannot lawfully be excluded.

To the fullest extent permitted by law, Latitude Escapes will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or a third-party service. Nothing in these Terms excludes liability that cannot be excluded under applicable law or limits obligations expressly stated in a confirmed reservation or signed Vacation Rental Agreement.


16 Guest Responsibility and Indemnification

To the fullest extent permitted by law, the Primary Guest agrees to reimburse and protect Latitude Escapes and its owner, managers, and representatives from third-party claims, losses, fines, or reasonable costs arising from the unlawful conduct, material rule violations, negligence, or intentional acts of the guest party or visitors. This section does not require a guest to indemnify any person for that person's own negligence or unlawful conduct to the extent prohibited by law.


17 Electronic Communications and Signatures

You consent to receive reservation-related notices, agreements, disclosures, invoices, and other communications electronically at the email address or telephone number you provide. You may retain electronic records by saving or printing them. An electronic signature or electronic acceptance may have the same effect as a handwritten signature when permitted by applicable law.


18 Privacy

Information submitted through the website is handled as described in the Latitude Escapes Privacy Policy and as reasonably necessary to respond to inquiries, process reservations and payments, manage stays, protect the property, meet legal obligations, and communicate with guests. Do not submit sensitive information through an unsecured message field unless specifically requested through a secure process.


19 Changes to These Terms

Latitude Escapes may update these Terms from time to time. The effective date at the top identifies the current version. Updated Terms apply to website use and reservation requests made after posting. Changes will not retroactively alter the cancellation policy or other material terms of a previously confirmed reservation unless the guest and Latitude Escapes agree in writing or the change is required by law.


20 Governing Law Severability and Entire Agreement

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. If a provision is found invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.

These Terms, the confirmed reservation details, the signed Vacation Rental Agreement, applicable property rules, the Privacy Policy, and any required waiver form the agreement governing a direct booking. For reservation-specific matters, the signed Vacation Rental Agreement and confirmed reservation details control over these website terms. No oral statement changes the agreement unless confirmed in writing by Latitude Escapes.
